By applying for a license to use classEx the user agrees to the following terms.
classEx gives the user a license to use classEx for commercial or non-commercial purposes. This right is non-exclusive and non-transferable. It does not include the right to grant sub-licenses. It includes the right to use the services of the website classex.uni-passau.de and download all data and graphics stored there. All data and graphics are subject to a Creative Commons license CC-BY-SA 3.0. They may therefore be used for all commercial or non-commercial purposes. Use of data or graphics requires proper citation of the source. Data generated by one user are made available to other users.
Apart from data and graphics the license agreement does not cover other files, in particular it does not cover the entirety of the software. classEx reserves exclusively all rights, titles and property rights with the exception of those explicitly mentioned in the license agreement. This refers in particular to the software and the use of the trademark classEx users are not permitted to read the source code, modify and otherwise manipulate. Any commercial use of the trademark by users is prohibited.
classEx employs open source software by third-party. Users agree to the terms of the respective suppliers.
classEx is constantly evolving. Games or services (eg, a processing mode) can be terminated without prior notice by classEx. Liability is excluded.
3. License Restrictions
Users may not rent, sublicense, sell or otherwise transfer rights under the license agreement. The removal of copyright notices or other proprietary notices from data or graphics that were downloaded from classEx is prohibited. The same applies to the preparation of derivative works, and reverse engineering. The use of classEx for unlawful activities is prohibited.
4. End of contract
classEx may terminate the license at any time without notice for any reason. Any attempt to use the services and data from classEx contrary to the license agreement results in the termination of the license agreement.
Each user is responsible for compliance with local laws and regulations as well as all potential contractual obligations that might arise from the use of classEx vis-à-vis third parties. The user bears sole responsible for any obligations towards participants, that is, visitors who attend a presentation by the user. When embedding images or similar copyright protected files the user is required to consider the respective rights and, if required, to acquire the necessary licenses.
6. Data Protection

The statutory provisions of the Data Protection Act (Datenschutzgesetz BDSG) of the German Telemedia Act (Telemediengesetz TMG) are applied. All personal data are subject to data protection. According to § 3 para. 1 BDSG these entail details about personal or material circumstances of an identified or identifiable natural person. This includes, for example, information on name, postal address, e-mail address or telephone number, and if applicable also usage data such as IP addresses.
Scope of the data collection and storage
No personal information as specified above is collected from participants. classEx stores only temporarily the IP address in order to prevent multiple voting. classEx uses the IP address also for determining the university or institution to allow faster login. The IP data is deleted immediately after completion of a game. If users collect personal data from participants, they are personally responsible for compliance with applicable data protection regulations.
If the use of classEx is terminated by of one of the parties, personal data of a user will be blocked and deleted after expiration of the deadlines specified by German Law.
